1. Introduction
Welcome to Wasil ("we," "us," or "our"). Wasil is a logistics facilitation platform operated under the domain usewasil.com that connects customers who wish to receive products from Saudi Arabia with verified travelers who transport sealed packages to destination cities. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services.
2. Definitions
- "Platform" refers to the Wasil website, application, and all related services accessible via usewasil.com.
- "Customer" refers to any user who orders or ships products from Saudi Arabia through the Platform.
- "Traveler" refers to any verified individual who transports sealed packages from Saudi Arabia to destination cities on behalf of the Platform.
- "Buy-For-Me" (BFM) refers to the service whereby Wasil purchases products from Saudi Arabian sellers on behalf of the Customer.
- "Bag" refers to a sealed, tamper-evident container containing one or more Customer packages assigned to a Traveler.
3. Eligibility
You must be at least 18 years of age and capable of forming a binding legal agreement to use the Platform. By registering, you represent that all information you provide is accurate and complete.
4. Account Registration
- You must create an account to use most features of the Platform.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
5. Service Description
5.1 For Customers
Wasil provides a logistics facilitation service that enables you to ship products from Saudi Arabia to supported destination cities. You may either ship your own purchases or use our Buy-For-Me service. Packages are received, inspected, photographed, weighed, and stored at our warehouse facilities in Madinah and Jeddah. We consolidate packages into sealed bags and coordinate with verified Travelers to transport them to your city, where our ground team handles last-mile delivery.
5.2 For Travelers
Travelers register their upcoming trips from Saudi Arabia, browse available sealed bags heading to their destination, and bid to carry them. Upon acceptance, Travelers pick up sealed bags from our warehouse and hand them off to our ground team at the destination. Travelers are compensated upon successful delivery.
5.3 Buy-For-Me Service
Customers may request that Wasil purchase products from Saudi Arabian sellers on their behalf. A service fee (currently 20% of the product cost) applies. Wasil acts as a purchasing agent and does not guarantee product availability, pricing, or seller performance.
6. Payment Terms
- All prices on the Platform are displayed in US Dollars (USD) unless otherwise stated.
- Payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service.
- Customers may fund their Wasil Wallet via Stripe and use the wallet balance to pay for shipping and BFM services.
- Shipping rates are calculated per kilogram based on the destination city and are displayed before payment.
- All payments are final once processed. Refunds are issued at Wasil's discretion and in accordance with Section 9.
- Traveler payouts are processed after successful delivery confirmation, using the payout method selected by the Traveler.
7. Shipping Terms
- Wasil facilitates shipping but does not operate as a licensed carrier. Packages are transported by verified Travelers.
- Delivery timelines are estimated and depend on Traveler availability and travel schedules. Wasil does not guarantee specific delivery dates.
- Customers must provide accurate destination addresses. Wasil is not responsible for delays or failures caused by incorrect addresses.
- All packages are sealed in tamper-evident bags. Travelers do not have access to the contents.
- Delivery is confirmed when the Customer acknowledges receipt or after 48 hours from the "out for delivery" status, whichever occurs first.
8. Prohibited Items
The following items may not be shipped through the Platform:
- Illegal substances or contraband
- Weapons, explosives, or hazardous materials
- Perishable goods (unless pre-approved)
- Live animals
- Items prohibited by Saudi Arabian export laws
- Items prohibited by the destination country's import laws
- Counterfeit goods or items infringing intellectual property rights
Wasil reserves the right to inspect, refuse, or dispose of any package suspected of containing prohibited items.
9. Cancellation Policy
9.1 Buy-For-Me Cancellations
- Customers may cancel a Buy-For-Me request at any time before the request enters "purchasing" status. A full refund will be issued to the Customer's Wasil wallet immediately.
- Once a request is in "purchasing" status, cancellation is subject to admin approval and may result in a partial refund depending on costs already incurred.
- Requests that have been purchased and received at the warehouse cannot be cancelled. The Customer may choose to ship or hold the package.
9.2 Shipment Cancellations
- Customers may cancel a shipment while it is in "paid" status (before it has been consolidated into a bag). A full refund will be issued to the Customer's Wasil wallet and packages will be returned to warehouse storage.
- Once a shipment has been consolidated, assigned to a Traveler, or is in transit, it cannot be cancelled by the Customer. The Customer must contact support for assistance.
- Wasil reserves the right to cancel any shipment at its discretion, in which case a full refund will be issued to the Customer's wallet.
10. Refunds & Disputes
- If a package is lost or damaged during transit, the Customer may file a claim within 7 days of the expected delivery date.
- Wasil will investigate all claims and, at its discretion, may issue a full or partial refund to the Customer's wallet.
- Refunds for Buy-For-Me orders that cannot be fulfilled are processed to the Customer's wallet.
- Wasil's total liability for any single shipment shall not exceed the total amount paid by the Customer for that shipment.
- All disputes must first be submitted to Wasil support at support@usewasil.com. If a resolution cannot be reached within 30 days, either party may pursue mediation or arbitration in accordance with Section 16.
11. Traveler Obligations
- Travelers must provide valid identification and complete the verification process before accepting any bags.
- Travelers must not open, tamper with, or attempt to access the contents of sealed bags.
- Travelers must deliver bags to the designated ground team at the destination within the agreed timeframe.
- Travelers who fail to deliver or tamper with bags may be permanently banned and may be subject to legal action.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Wasil and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Platform. Wasil's aggregate liability for any claim shall not exceed the amounts paid by you to Wasil in the twelve (12) months preceding the claim.
13. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
14. Termination
- You may close your account at any time by contacting support@usewasil.com. Outstanding orders or shipments must be resolved before account closure.
- Wasil may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.
- Upon termination, any remaining wallet balance (minus any outstanding obligations) will be refunded within 30 business days.
15. Modifications
Wasil reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in New York County, New York.
